General Terms and Conditions dated 14-3-2023.

Article 1. Application

1. Online-hobbyshop.com is part of Grootspoor.com. Hereinafter referred to as Online-hobbyshop.com
2. Online-hobbyshop.com has its own terms and conditions as described on this page.
3. Unless otherwise agreed in writing between the parties, these terms and conditions apply to all offers made by Online-hobbyshop.com, and to all agreements to be concluded by Online-hobbyshop.com regarding the delivery of products and / or performance of work.
4. These terms and conditions can only be deviated from if agreed otherwise in writing in advance.
5. By making a purchase or submitting a delivery order, the client accepts these general terms and conditions.

Article 2. Offers and assignments

1. Unless otherwise stated, all written offers made by Online-hobbyshop.com are valid for 14 days. This is subject to an article being sold out within this period.
2. Oral assignments are confirmed in writing by Online-hobbyshop.com if desired. Online-hobbyshop.com is only bound by written confirmation.
3. If the client / buyer has not objected in writing to the order confirmation and / or delivery of products and / or services from Online-hobbyshop.com within 7 working days, the content of the agreement is deemed to have become irrevocable and the consent of all parties to have.
4. Drawings, photos, reports, designs and calculations remain, even after the assignment has been granted and the payment thereof, the property of Online-hobbyshop.com and copyrights also remain with Online-hobbyshop.com.
5. No rights to delivery can be derived from the fact that articles are listed on the website.
6. Online-hobbyshop.com uses, where available, text and images provided by the manufacturer. Online-hobbyshop.com is not responsible for any deviations to the product compared to the images used. An exception to this are the materials used, for which Online-hobbyshop.com itself is responsible for ensuring that images correspond to the product. If there are deviations in the product compared to the image used, Online-hobbyshop.com will clearly state this in the additional information about the product in question.
7. Manufacturers are free to change colors and compositions of articles in the meantime, Online-hobbyshop.com, as well as other retailers, are often not informed of this. Online-hobbyshop.com is not responsible for color deviations or deviations in the composition of products that have been changed unannounced by the manufacturer.

Article 3. Delivery

1. Online-hobbyshop.com will deliver the product within 14 days after receipt of payment, except in case of force majeure.
2. Force majeure applies, among other things, if suppliers, despite a demonstrably timely order by Online-hobbyshop.com, do not meet their delivery obligations on time. In such a case, the client cannot derive any rights from such negligence of a supplier of Online-hobbyshop.com.

Article 4 Warranty

1. All items offered by Online-hobbyshop.com are sold with a manufacturer's warranty.

Article 5. Payment

1. Articles are only delivered after payment has been received by Online-Hobbyshop.com.

Article 6. Indemnity and liability

1. The client indemnifies Online-hobbyshop.com against claims from third parties for compensation of damage, unless this damage is due to intend or gross negligence on the part of Online-hobbyshop.com, its staff. Online-hobbyshop.com is not responsible for subcontractors or suppliers.
2. Errors or omissions in the performance of the work of Online-hobbyshop.com, by its subordinates or by persons appointed by Online-hobbyshop.com at the work.
3. The maximum damage to be compensated by Online-hobbyshop.com with regard to an article is limited to the amount that the client owes Online-hobbyshop.com with regard to that article, or the value which a damaged product in the delivered condition would have in value at that time.
4. Online-hobbyshop.com's liability under the agreement is expressly limited to what is stated in the previous paragraphs of this article, any other claim against Online-hobbyshop.com with regard to business damage and / or other direct or indirect damage, of any nature or extent therefore, is excluded.

Article 7 Shipment

1. Online-hobbyshop.com ensures proper packaging and clear addressing.
2. In the case of uninsured shipping or shipping by envelope (insofar as the envelope shipment is not registered as a package), this is done entirely at the risk of the recipient.
3. The responsibility for the choices in the way of sending lies with the recipient. The recipient must clearly indicate when ordering whether insured or uninsured shipment is desired. The recipient is responsible for providing the complete and correct address. If it appears that the recipient has supplied the address incorrectly or incompletely, all consequences thereof will be for the recipient, as well as any 2nd shipping costs.

Article 8. Distance Selling Act

2. A right of withdrawal applies to a distance purchase, which is another word for a reflection period. You may return the product to Online-hobbyshop.com within 14 days. Without giving any reason. For each return shipment, € 15 costs is charged.
3. Costs for the return shipment are borne by the buyer.
4. The 14-day period starts from the moment you receive the product or the written confirmation (when ordering via the webshop, this is the order confirmation that will be sent to you by email.) Of the purchase.

You have no right of withdrawal:

1. For customization or for a product with a different, clearly personal character.
   1. For products that are damaged, are received back damaged by us or new products that are delivered new and used are returned.
   2. After the term of acceptance of the offer.

Article 14. Disputes

1. Disputes between parties are settled by the competent court in Alkmaar.
2. Dutch law applies to all disputes between the parties.
3. The German and English translations of these General Terms and Conditions are only a translation intended as a guide for the German and English-speaking customers. In the event of a dispute, only the Dutch version applies.

Article 15. Uncollected Orders

1. Orders that have been paid for and made available for collection must be collected within 3 months of the notification of availability, unless otherwise agreed in writing.
2. If an order is not collected within this period and the customer has not responded to repeated reminders, the order will automatically be cancelled. In such cases, Online-hobbyshop.com is no longer obliged to deliver the order or refund the purchase amount.
